Senate file 973 - Pharmacy Benefit Management - Audits

Sponsor: Senator Gretchen Hoffman (R)

Summary: Establishes a pharmacy audit integrity program to provide standards for an audit of pharmacy records carried out by a managed care company, insurance company, Medicare Part B audit contractors, third-party payor, pharmacy benefits manager, health program administered by a state agency, or any entity that represents such companies.

Status: Introduced and referred to House Health and Human Services Reform Committee 3/21/2011. Hearing held 4/26/2011. Carried over upon adjournment 5/23/2011. Hearing scheduled for tomorrow, Wednesday, March 21.

Outlook: This hearing will be open to the public and testimony will be accepted at the discretion of the chair. Committee meeting agendas can change with little notice and bills are usually voted on when they are heard.

The bill sponsor, Senator Gretchen Hoffman (R), is a member of the majority party, and serves on the committee of referral, the Senate Health and Human Services Committee. The bill has three additional co-sponsors, both Republicans and DFLers, including Representative Steve Gottwalt (R), the chair of the committee of referral. The sponsor has gathered a bipartisan coalition in support of this measure. Bipartisan support is seen as an important indicator for a bill’s prospects as Republicans control both legislative chambers, while the Democrats control the Governor’s Office.

A companion measure has been introduced in the House (HF 1236) and has been referred to committee. Having a companion in the opposite chamber indicates an increased likelihood a measure will be considered.

The Senate Health and Human Services Committee is scheduled to hear Senate file 973 tomorrow, Wednesday, March 21.

It is critical that Committee members hear from constituents about Senate File 973 in advance of the hearing. Please urge constituents of these lawmakers to call before Tuesday (contact information below) to express support for SF 973.
